Code of Ethics 2: Control and Use of Citizen Private Information

Purpose: To ensure citizen data is collected, stored, and used ethically, securely, and aligned with Belize’s legal framework.

1. Confidentiality of Citizen Data

  • PSR Basis: Regulation 47 (confidentiality) and Regulation 53 (access to information procedures).

  • Rules:

    • For statistical reporting, citizen information (e.g., tax records and health data) must be anonymized.

    • Access to sensitive databases (e.g., immigration, social services) requires multi-factor authentication and approval from a department head.

2. Email and Data Transmission

  • PSR Basis: Regulation 51 (prohibition on unauthorized technology use).

  • Rules:

    • Citizen data transmitted via email must be encrypted using government-approved tools (e.g., PGP).

    • Cloud storage of citizen data is prohibited unless hosted on government-certified servers.

3. Social Media and Public Interaction

  • PSR Basis: Regulation 54 (media conduct) and Regulation 47 (confidentiality).

  • Rules:

    • Public officials shall not:

      • Share citizen information (e.g., names, addresses) on social media, even inadvertently (e.g., visible documents in photos).

      • Respond to citizen queries on personal social media accounts; direct them to official channels.

    • Enforcement Rationale: To prevent doxxing, identity theft, and Freedom of Information Act breaches.

4. Monitoring and Accountability

  • PSR Basis: Regulation 89 (record-keeping of disciplinary proceedings).

  • Rules:

    • Regular audits of citizen data access logs must be conducted quarterly.

    • Employees accessing citizen records without authorization face immediate suspension (Regulation 84: major misconduct).

5. Off-the-Job Behavior Impacting Citizen Trust

  • PSR Basis: Regulation 40 (public service integrity).

  • Rules:

    • Employees engaging in off-duty behavior that erodes public trust (e.g., discriminatory remarks at a private event reported in the media) may be subject to disciplinary action.

6. Innovative Safeguards

  • Data Minimization: Collect only essential citizen information; justify additional data requests in writing.

  • AI-Driven Anomaly Detection: Deploy algorithms to flag unusual data access patterns (e.g., bulk downloads).

  • Citizen Consent Portals: Digitize consent forms for data sharing with blockchain timestamps to prevent tampering.

Enforcement:

  • Violations of either code will be investigated under PSR Part 10 (Discipline of Public Officers), with penalties ranging from suspension (Regulation 85) to dismissal (Regulation 86).

  • Annual ethics certification is required for all employees, with failure resulting in loss of system access.

Rationale: These codes align with Belize’s constitutional mandate for a professional, impartial public service to mitigate risks of data breaches, corruption, and reputational harm and provide for the safeguarding of citizen data.
